Owner Relations FAQ

What is a division order and why am I receiving one?

A Division Order is an instrument which sets forth the proportional ownership in a carbon sequestration unit.

You are receiving a Division Order because property in which you have an interest has been made a part of a unitized area as approved by the
Wyoming Oil and Gas Conservation Commission (WOGCC).

What is an injection payment (IJ)?

Injection fee payments will be made to the pore space owners pursuant to the Unitization Agreement approved by the WOGCC.

Why do I need to include my social security number on my division order/transfer order?

A valid Tax Identification Number (TIN) or Social Security Number (SSN) must be provided to Tallgrass for reporting and identification purposes. If the appropriate TIN is not received, Tallgrass is required to withhold 28% (30% for foreign residents) of your payment and remit it to the IRS. If you do not wish to supply your TIN/SSN, please make note in the TIN/SSN section of the Division Order/Transfer Order.

When are checks mailed?

Checks are mailed quarterly.

Name changes

When an individual’s name changes because of marriage, divorce, etc. please furnish a copy of the marriage certificate, death certificate, or other document effecting the name change.

When a company has a name change, Tallgrass requires a recorded copy of the Certificate of Name Change. If the change is due to a merger, please furnish a recorded copy of the Certificate of Merger.

Change of ownership due to divorce

Tallgrass will require a copy of the divorce decree and copies of the conveyances recorded in the county where the property is located.

Guardianships

If an owner is declared incompetent, please furnish Letters of Guardianship issued by the local court. When a minor reaches legal age we will require a copy of the minor’s birth certificate.

Sale of interest

For a full or partial conveyance we will require a copy of the conveyance document recorded in the county and state where the subject property is located.

Tallgrass policy prevents the transfer of payments without a copy of the recorded deed, conveyance or assignment.

When an owner dies

When an owner dies without a will, furnish as many of the following documents:

  • Death Certificate
  • Letters of Administration
  • Order Determining Heirship and Distribution

Individual state laws on descent and distribution differ. Tallgrass will inform you if additional information is needed.

When an owner dies with a will which has been admitted to probate proceedings in the same state where the producing property is located, furnish as many of the following documents as possible:

  • Death Certificate
  • Application for Probate
  • Copy of the Will
  • Order admitting Will to Probate
  • Letter Testamentary
  • Personal Representative’s Deed
  • Final Court Decree distributing the assets and closing administration of the estate

In some situations, other documents determined by Tallgrass Division Order Department may be needed.

Termination of joint tenancy upon death

Tallgrass will require a copy of the Death Certificate. Please furnish the new Social Security or Tax Identification number for the surviving joint tenant.

Life tenant dies

When an owner of a life estate dies, Tallgrass will require a copy of the Death Certificate and the names, addresses and Social Security numbers of the persons who own the remainder and who succeed to the interest.

In some situations, Tallgrass will need further information including the documents that created the life estate and named successors.

Unclaimed property

Unclaimed property refers to the unpaid amounts associated with suspended and/or unknown owners, which must be reported to various states after statutorily defined periods of time have elapsed due to no contact. Pursuant to state law, funds will be escheated to the state of last known residence. Each state has a database for unclaimed property reporting. You may search “unclaimed property” and your state of residence.
